- He has arbitrated over 30 international commercial cases in New York, Stockholm, Moscow and Kyiv.
In New York these have included:
- Serving as an emergency arbitrator in two AAA cases involving disputes under franchise agreements, two AAA cases involving asset sales agreements and an AAA case involving performance under a corporate restructuring agreement.
- Serving as the sole arbitrator in an ICDR case involving payment and performance disputes under an asset purchase agreement.
- Serving as the sole arbitrator in seven AAA/ICDR cases involving disputes under
franchise agreements. - Serving as the sole arbitrator in six AAA consumer cases involving contract performance disputes, allegations of fraudulent bank wire transfers and dispositive motions.
Internationally these have included:
- Party-appointed arbitrator in an Russian Chamber of Commerce and Industry in Moscow (ICAC Russia) case involving a dispute between a regional airline in Siberia and a Mongolian equipment vendor (in Russian).
- Chair of two separate arbitral tribunals formed by the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) to arbitrate commercial disputes in Stockholm.
- Chair of an arbitral tribunal formed by the International Commercial Arbitration Court attached to the Ukrainian Chamber of Commerce and Industry in Kyiv (ICAC Ukraine).
- Party-appointed arbitrator in five cases at the International Commercial Arbitration Court attached to the ICAC Russia (in Russian).
- Chair of an arbitral tribunal in Moscow formed under the auspices of the Joint Corporate Ethics Commission of the Russian Union of Industrialists and Entrepreneurs (RSPP) (in Russian).
- Party-appointed arbitrator in an ICAC Ukraine arbitration involving a dispute between a Russian chemicals producer and a Ukrainian pipeline company over pipeline tariffs (in Russian).
- Party-appointed arbitrator in a SCC arbitration involving a dispute between a American supplier of equipment and a Ukrainian state-owned company over the failure to deliver equipment.
- Party-appointed arbitrator in an ICAC Russia arbitration involving a dispute under an acquisition agreement between a large Russian industrial company and sellers who sold shares to the Russian company over representations and warranties in the contract (in Russian).
- Chairman of an SCC arbitration involving a dispute between an Eastern European supplier of equipment and a large Russian industrial company (in Russian).
- Chairman of an SCC arbitration involving a construction contract dispute between a Western retail operation doing business in Russia and a Chinese state-owned construction company over defects in construction (in English).
- Sole arbitrator in an arbitration at the Russian Arbitration Center involving a dispute under a construction contract (in Russian).
- Sole arbitrator in an ICDR arbitration in New York involving a dispute between a New York construction company and an entity in China over the payment of finders fees.
Mediation Experience
- Mr. Pettibone is an accredited mediator by the Centre for Effective Dispute Resolution (CEDR).
- He has been trained as a mediator by CEDR, by the New York State Bar Association Dispute Resolution Section and by CPR.
- He is a Special Master at the Appellate Division, New York State Supreme Court, First and Second Departments, is on the roster of mediators at the Commercial Division of the New York State Supreme Court and the roster of mediators at the AAA, and he has successfully mediated over 20 cases at the Appellate Division, First and Second Departments, NYS Supreme Court.
- He has mediated cases on a virtual or remote basis using video conferencing technology and techniques.
